Generally, partners should create an operating agreement or partnership agreement when they create a business. The agreement can outline the partners rights and responsibilities with regards to the business and the partners. The operating agreement will generally govern any dispute. There may be other situations in which it is necessary to take a partner to court or some form of alternative dispute resolution.
